Terms & Conditions

1. Introduction and Acceptance of Terms
1.1. Scope: These Terms and Conditions (the "Terms") govern your use of the website www.simplifysimplifying.com (the "Site"), and all related services, content, digital/printed products, and 1:1 coaching services provided by Simplify Simplify-ing (referred to herein as "we," "us," or "our").
1.2. Agreement: By accessing, browsing, purchasing products, or engaging in coaching services, you agree to be bound by these Terms, our Privacy Policy, and our Shipping Policy. If you do not agree to these Terms, you must cease use of the Site and our services immediately.
1.3. Australian Jurisdiction: Simplify Simplify-ing operates as an Australian small business. These Terms are governed by the laws of New South Wales, Australia, and the Commonwealth of Australia, including the Australian Consumer Law (ACL).
2. Intellectual Property Rights (IP)
2.1. Ownership: As a qualified Designer, all content, including but not limited to the design of the Site, written text, graphics, logos, images, digital product files, printed product designs, coaching frameworks, podcast content, and social media posts, are the exclusive intellectual property of Simplify Simplify-ing and are protected by Australian and international copyright laws.
2.2. Limited License for Use:

Personal Use Only: All digital and printed products, including coaching materials, are sold for personal, non-commercial use only.

Prohibited Actions: You may not copy, reproduce, redistribute, sell, modify, license, or create derivative works from any content or products without express prior written permission from us. This includes sharing digital files with third parties.
2.3. Custom Design/Branding Work (If applicable): If we create custom design or branding work for you as a Designer, the transfer of IP ownership will be governed by a separate written agreement (Scope of Work or Design Contract) signed by both parties.
3. Online Store - Products and Sales
This section applies to all purchases made through the Simplify Simplify-ing online store, including Digital, Physical and Printed Products.
3.1. Pricing and Payment: All prices are listed in Australian Dollars (AUD) and include GST where applicable. Payment must be made in full at the time of purchase.
3.2. Australian Consumer Law (ACL) Guarantees:

Our goods come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
3.3. Digital Products:

Delivery: Digital products are delivered instantly via email and/or a download link on the order confirmation page.

Refunds: Due to the immediate nature of delivery, we do not offer refunds for change of mind on digital products. Refunds are only available if the product fails to meet a consumer guarantee (e.g., the file is corrupt, fundamentally defective, or not as described).
3.4. Small Printed Products:

Shipping & Delivery: All shipping, delivery, processing times, and costs are governed by our separate Shipping Policy, which is incorporated into these Terms by reference.

Risk: Risk of loss or damage to printed goods passes to you upon dispatch from our premises, but we remain responsible for ensuring the goods meet the ACL guarantees upon delivery.

Damage/Loss: If a printed item is damaged or lost in transit, remedies (replacement or refund) will be processed in accordance with the ACL and our Shipping Policy, provided you contact us immediately with supporting evidence.

Custom Printed Orders: All custom orders are non-refundable once final design approval has been given, unless the final product has a major defect or fails to match the specifications agreed upon in the custom quote.
4. 1:1 Coaching Services
This section applies to all personalised Design and Simplify coaching, and program services.
A. Professional Disclaimer and Client Responsibility
4.1. Not Medical Advice: Lisa is a qualified Designer, Health and Nutrition Coach, and Yoga Teacher, but services are not a substitute for medical diagnosis, treatment, or advice from a licensed healthcare professional (such as a GP, Psychiatrist, or Dietitian).

The information provided during coaching sessions is educational and supportive only.

You understand that I do not diagnose conditions, prescribe medication, or treat illness.

You must inform your primary healthcare provider of your participation in any health or nutrition program.
4.2. Physical Activity Waiver (Yoga/Exercise):

You understand that participation in yoga or exercise involves inherent risks of injury.

You confirm that you are physically fit and well to participate, or have sought clearance from a medical professional.

You agree to assume full responsibility for any risks, injuries, or damages, known or unknown, that might incur as a result of participation in private or virtual yoga classes or movement recommendations.
B. Booking, Payment, and Cancellation
4.3. Booking Confirmation: All coaching sessions must be booked and paid for in advance to secure your time slot.
4.4. Cancellation Policy (Client):

Cancellations or rescheduling requests must be received via email at least 48 hours before the scheduled appointment time.

Cancellations made with less than 48 hours' notice will forfeit the full session fee.
4.5. Cancellation Policy (Simplify Simplify-ing): We reserve the right to cancel or reschedule a session due to unforeseen circumstances. In such an event, you will be offered a full refund or the option to reschedule at your convenience.

COACHING The Client is engaging the Business for coaching services to be provided by the Business’s Coach(s) (the “Coach”) in 1 hour Coaching Sessions. Our Coach is qualified to support clients in goal setting, motivational interviewing, habit implementation and identifying blocks.
Scope of Practice: Lisa Hogan - Health Coach - Institute for Integrative Nutrition - 2012
Scope does not include counselling, psychology or psychiatry or specific recommendations.
SELF CARE The Client is engaging the Business for coaching services to be provided by the Business’s Coach(s) (the “Coach”) in 1 hour Coaching Sessions. The Coach is qualified to support clients in implementing self care habits and identifying less ideal habits, in addition to incorporating simple Yoga stretches, beginner Breathing and Meditation moments in their day.
Scope of Practice: Lisa Hogan - Yoga Teacher 200hr - Australian Yoga Academy - 2013-2014
Scope does not include professional Beauty / Aesthetician, advanced Breathwork / Meditation
FITNESS The Client is engaging the Business for Training services to be provided by the Business’s Trainer(s) (the “Trainer”) (subconsultant to Simplify Simplify-ing) in 1 hour Training Sessions. The Trainer will design a 4 Week Training Plan in line with the Client’s fitness level, experience and goals, suited to either gym, or home training tailored to the equipment available. Activities may include and are not limited to: testing physical fitness; exercise; training: aerobic conditioning; cardiovascular and strength training; and mobility.
The Trainer may be engaged as often as the Client wishes to guide them through training sessions virtually or in person, and/or to update their Training Plan every 4 weeks.
Scope of Practice: Personal Trainer - Cert 3 & 4 - Fitness Australia - 2021
Scope does not include injuries or rehabilitation, pregnancy or prenatal, or professional athletes.
FOOD The Client is engaging the Business for Coaching services to be provided by the Business’s Coach(s) (the “Coach”) in 1 hour Training Sessions. Our Coach is certified to provide advice in line with the Australian Dietary and Eat for Health Guidelines. This may include finding recommended food group servings, in line with Client’s lifestyle and goals, creating a meal template with the Client, and discussing ways to implement simple shopping and cooking habits.
Scope of Practice: Lisa Hogan - Nutrition Coach - Australian Institute of Fitness - 2019
Scope does not include specific Meal Plans, Food, Nutrient or Supplement recommendations.
STYLE The Client is engaging the Business for coaching services to be provided by the Business’s Coach(s) (the “Coach”) in 1 hour Coaching Sessions. As a Designer, the Coach is qualified to support clients in creating a vision of their ideal wardrobe, organise and minimise their existing wardrobe, identify pieces needed and creating outfits for each part of the Client’s life.
Scope of Practice: Lisa Hogan - Designer - B. Design Hons - UTS - 2006 - 14 years experience
Scope does not include professional styling or alteration, based on body type, fit or colour palette
HOME The Client is engaging the Business for coaching services to be provided by the Business’s Coach(s) (the “Coach”) in 1 hour Coaching Sessions. As a Designer, the Coach is qualified to support clients in identifying home zones and how each is used, home organisation and creating systems to simplify cleaning and maintaining organisation, so the Client can enjoy their space.
Lisa has experience using natural and allergy-friendly cleaning products due to personal health.
Scope of Practice: Lisa Hogan - Designer - B. Design Hons - UTS - 2006 - 14 years experience
Scope does not include Interior Design, Building DIY, or specific product recommendations
WORK & ADMIN The Client is engaging the Business for coaching services to be provided by the Business’s Coach(s) (the “Coach”) in 1 hour Coaching Sessions. As a Designer, the Coach is qualified to support clients in identifying tasks, priorities and creating systems to simplify actioning and maintaining organisation, in addition to structuring branding and content creation, so the Client can enjoy their work.
Scope of Practice: Lisa Hogan - Designer - B. Design Hons - UTS - 2006 - 14 years experience
Scope does not include Graphic Design services, or specific design recommendations.
5. Content and Media Use (Social Media & Podcast)
This section applies to all free content distributed via social media platforms, the podcast, and the Site.
5.1. Informational Purposes Only: All content, including tips on design, health, nutrition, and yoga, is created for general information and entertainment purposes only. This content is not tailored to your specific health status, personal circumstances, or design project needs.
5.2. No Professional Relationship: Consumption of our free content (reading an Instagram post or listening to a podcast episode) does not create a Coach-Client relationship, Yoga Teacher-Student relationship, or Designer-Client relationship. A professional relationship only begins upon formal engagement and payment for a 1:1 service or custom order.
6. Limitation of Liability
6.1. Extent of Liability: To the maximum extent permitted by Australian Law, Simplify Simplify-ing (including its owner) shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your access to, or use of, the Site, products, or services.
6.2. Exceptions: This limitation does not exclude or restrict the application of the ACL where it would be illegal to do so. Our liability for failure to comply with a guarantee under the ACL is limited to:

In the case of goods: replacement of the goods or supply of equivalent goods; or payment of the cost of replacing the goods or acquiring equivalent goods.

In the case of services: supplying the services again; or paying the cost of having the services supplied again.
7. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the updated Terms on the Site. Your continued use of the Site or services after any changes constitutes your acceptance of the new Terms. The date of the last revision will be noted at the top of this document.
